This agreement is between Sherebiah Designs (Photographer), operating in the state of North Carolina, and _________________________________________(Client),residing at ________________________________ (address) relating to the Clients’ wedding that will take place on  ____________________ at __________ am/pm at __________________________________ which is located at ________________________________________, and the reception following at ________________________________.

Description of Services
Sherebiah Designs will furnish photographic coverage of the wedding on the above date. Coverage will include the services of a photographer to begin approximately one and a half hours prior to the wedding. However, due to circumstances beyond the photographer’s control, this start time is not guaranteed. Approximately four weeks after the date of the wedding, the Photographer will deliver to the Clients a link to their online album of edited photos.  Within 6-7 weeks of editing photos, the coffee table book should be delivered.

Prices & Fees
The price for the Coverage is $__________ This price is guaranteed. Since the Photographer does not have control over his suppliers, in the event that the Photographer’s supplier no longer offers a particular album that is currently being offered in the Photographer’s package, another of the same value will be offered.  

Pricing for all services and products is defined on the www.sherebiah.com price list attached to this contract. All package prices are guaranteed with no increases.  These prices will be guaranteed for a period of four months following the date of the wedding. Orders placed after the four months will be charged at the rates in effect on the most recently published price lists on www.sherebiah.com.

Payment
A retainer in the amount of $100 is due and payable at the time the contract for photography services is signed. The remaining balance of $_______ is due no later than ___ days prior to the wedding.  If we will provide video, there will be a separate $100 retainer for the video- grapher with the balance of $_____ due ____ days before the wedding.
Clients may make monthly payments if they wish.  Sherebiah Designs will provide a receipt for all monthly payments.  All outstanding balances must be paid prior to the wedding.  If not, we won't be able to travel if your wedding is out of town, no photos will be edited or posted online, no books designed or ordered.  All of these processes will begin on the day the balance is paid.   Upon receipt of the retainer, Sherebiah Designs and Gifts will reserve the date and time agreed upon and will not make other reservations for that date and time. For this reason, the retainer fee of $______is non-refundable, in the event the date is changed, a different photographer is retained or wedding cancelled for any reason.

Limitation of Liability
While every reasonable effort will be made to produce and deliver outstanding photographs of the wedding events, the Photographer’s entire liability to the Clients for any claim or loss is limited to a refund to the Clients of the amount the Clients paid for the particular service in question minus the retainer (for expenses incurred).  The bridal session, if included, is a separate event from the wedding and the wedding is separate from the bridal session.  They will not be combined in any way with any dispute that results in a refund.  Also, the photography and videography are separate events.  In the event of a technical failure with the video resulting in the majority not being filmed, only the video portion of the package price will be refunded. 

Since the Clients have already previewed our portfolio and have attested to our qualifications by retaining our services and since taste varies greatly, no refunds will be given except in the event of an actual technical failure with the equipment resulting in the majority of the photos being ruined.  The Clients are responsible for making sure the locale provides the Photographer and/or Videographer with adequate lighting to fulfill their obligation.  Should the Photographer and/or Videographer deem that lighting or view is inadequate, signing this contract also provides them with permission to use flash and/or position themselves anywhere they need to be in order to accomplish their objective which is telling your wedding story to the best of their ability.

Because a wedding is an event teeming with emotion and action, the Photographer will try but cannot guarantee delivery of any specifically requested image(s) of a particular person or event.  Since the Photographer/Videographer may be going around getting great candids of guests at the reception between the special activities, it is the Clients’ responsibility to ensure that we are there at the ready before cutting cake, toasting, bouquet/garter/rice throwing.  It is also the Clients responsibility to make sure that in the unlikely event of personal illness or other circumstances beyond control of the Photographer, a substitute photographer of equal or greater qualifications will be sent to fulfill the obligations of this Agreement without any further obligation or compensation to the Client.

Rehearsal
Sherebiah Designs Photographer reserves the right (but is under no obligation) to attend the rehearsal, not to photograph it, but for the purpose of getting to know the parties involved, to know where the bride and groom will be getting ready, ask logistical questions and be aware of how the ceremony will proceed on the wedding day.

Bridal Session 
Photographer agrees to provide bridal session portraits (if it is part of your package) based on a mutually agreed upon location, date and time. Clients will be provided all proofs in their online album that meet with the Photographer’s standard of quality. The Photographer will use a digital camera for this session and the wedding.  The Client accepts all risk in taking the bridal gown to the on-location bridal portrait session.  The Photographer will not be held responsible for any damage to the dress. 

Terms and Conditions
These Terms and Conditions are understood and agreed upon by the Photographer and the Client.

Copyright & Usage
Clients will have absolutely no rights to the negatives, digital media files or original video.  These are the exclusive copyrighted property of Sherebiah Designs. Clients will not make copies for the purpose of circumventing the sale of images by the Photographer, nor will the Clients authorize any reproductions of the images as establishments that do this are at risk of being assessed a $10,000 fine for each copy. Photographer retains the copyright to all images created and will have the right to include images in portfolio samples, self-promotions, professional competitions and other business related uses.

Agreement
This Agreement is not valid until it is signed by the Client and the Photographer and has been received along with payment of the retainer as specified by the Payment terms above. This Agreement incorporates the entire understanding between the Client and the Photographer. Any modifications of this Agreement must be in writing and signed by all parties. Each person signing below will be fully responsible for ensuring that full payment is made according to the terms of this Agreement. The laws of the State of North Carolina will govern this Agreement.
